Anti-Spam & Messaging Policy
Effective: Last updated 2026-09-19 · Version: 2026-09-19
1. Our position
Tomonagi is a tool for talking to people who want to hear from you. Unsolicited commercial email and unsolicited text messages are not allowed on the Service, in any volume, for any reason. This policy exists to protect the people our customers contact, to protect our customers from one another (a spammer on a shared platform hurts everyone's deliverability), and to meet our own obligations under the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles, and the carrier rules enforced by The Campaign Registry.
2. What counts as consent
You may only message a person who has given you permission that you can prove. Acceptable permission includes: the person filled in your web form and ticked an unchecked box agreeing to receive messages from you; the person texted a keyword to your number; the person signed a paper or electronic form that names you and says they agree to receive messages; or the person is an existing customer with whom you have a current business relationship and the message is about that relationship.
For text messages, the consent must be prior and express. For marketing texts it must be prior express written consent, which the web-form checkbox and a signed form both satisfy. Purchased lists, scraped numbers, numbers copied from a directory, and numbers collected for one purpose and used for another are never consent.
The Service records the consent it collects (the form, the timestamp, the wording the person saw). Keep your own records for consent collected outside the Service; you may be asked for them.
3. Every message must carry
Email: an accurate From name and address that identifies your business; a subject line that is not misleading; a working unsubscribe link; and your physical mailing address. The Service adds the unsubscribe link, the List-Unsubscribe header, and the address footer to commercial email automatically. Removing, hiding, or breaking them is a violation of this policy.
Text messages: your business name so the recipient knows who is texting; a way to opt out (STOP) and get help (HELP), which the Service honors automatically on every number it manages; and, on the first message or the consent form, the disclosures that message frequency varies and that message and data rates may apply. Message frequency varies; you may receive up to 10 messages per month.
4. Opt-outs are final until the person opts back in
When a person unsubscribes from your email or replies STOP to your texts, the Service stops sending to them on your behalf immediately and records the opt-out. You may not re-add them, message them from another number, or move them to another list. A person who later replies START, re-submits your form, or otherwise re-consents may be messaged again from that moment.
Opt-outs are per business. A person who stops one business's messages has not opted out of a different business that uses the Service.
5. Content that is never allowed
Messages that are deceptive or impersonate someone else; messages about cannabis, firearms, tobacco or vaping, gambling, adult content, high-risk lending, debt relief, or get-rich-quick schemes (carriers block these categories on standard numbers regardless of consent); messages that contain malware or phishing links; messages that harass or threaten; and messages sent to numbers on a do-not-call list where the law forbids it.
6. How we enforce this
We monitor complaint rates, bounce rates, opt-out rates, and carrier feedback. When a sender's numbers indicate spam, we may pause sending, require you to re-verify your consent records, limit your volume, or suspend messaging features. In serious or repeated cases we may terminate your account under the Terms of Service. Where the law or a carrier requires it, we may also report the activity.
Report abuse to jbyron@tomonagi.com. Include the message, the sender, and the number or address it reached. We look at every report.
7. Who is responsible
You are the sender of every message you create, schedule, or automate through the Service. Javill Byron, doing business as Tomonagi provides the delivery tooling and the compliance guardrails described here; we do not review your messages before they go out and we are not responsible for their content. The Terms of Service set out the indemnity that applies if a claim arises from your messaging.
